That was pretty simple and easy. Once that is done, we were good to go. We did not find it to be a hassle. It was pretty much easy for us to set up this business since we had the capital. We have a shop on the ground floor and we have a house above the shop in the same building. Back then the process wasn't online. Now my son says that the process of getting a food license and registering process of Delhi has gone online. It took almost a month for us to register the business and getting license to serve food. But my guess is getting permissions would have been more difficult if we would serve alcohol. | Start a business where you have no competition or likely to have less competition. If you are in the food business and you maintain hygiene then it is likely that customers will come irrespective of the price you charge. We have a family business of automotive aftermarket in Ahmadabad, Gujarat. We tried to register the business, get water and electricity connection and register for trade outside the state/ country. It was easy for us to start the business because we took help of our sales tax consultant to get the registration process initiated. His guidance and the ‘right’ contacts he had facilitated the registration process. | My advice for others would be – go through an expert accountant or a lawyer who has an expertise in the domain of getting the business or a start up registered. Have all your documents in place for the process to be faster. Under Swatchh Bharat mission, the municipal corporations are supposed to build and operate public toilets and community toilets. Even after identification of land, the allocation process is not very clear at district levels. The MC should identify land and make it readily available for interested parties to built and operate toilets by CSR funds. There is no clear mechanism/process/instruction how to apply for land for building toilets. hence it took us more than 6 months to get land. |

There was denial for commercial electric connection on freehold plots. They agreed later, after repeated requests and talking strictly in a stern tone. I needed to get commercial connection to another freehold plot and I am not sure whether I will be able to get that without paying bribe or not. Auditors also tell you a lot of rules at the time of inspection, seek monetary benefits to turn a blind eye. There is no website or one place where we can get a list of all the rules to be followed. The process of registering a firm is also ironical. They ask three guarantors who have been doing business for last couple of years (I think 3 or more) and have been filing returns timely. In case you do not have three guarantors you can also get a fixed deposit opened of 25,000 in the name of the firm and use that as the guarantee. Now the irony here is that hardly any bank would accept to open a fixed deposit in the name of the firm which is not yet registered. Since we did not know enough businessmen in Greater Noida, we visited a number of banks who refused to accept money and open a FD in the firm's name. Luckily I met a bank manager who understood and agreed to help. This is how we got a FD and hence were able to get the firm registered almost when we were about to lose hope. Another experience is that when two different states get involved, different taxes also get involved. This is applicable for goods being brought into Delhi from another state on C.S.T. We need to share a copy of bill with the Delhi client who then sends a D-form and only then can the goods be brought into Delhi with the bill and the D-form from the client. This form contains same information present on the bill i.e. - date, goods, quantity, vehicle registration number and the billed amount. This process can be managed if you bill electronically and share the documents via email. Doing the same manually will involve additional delays. I think GST might be a big step in resolving this issue. |

Can’t find information | There is no guide book which can direct you to do things. The procedures and processes are complicated. This leads to unnecessary waste of time and a hole in your pocket. There is a lot of competition in Vizag in the Fishing sector, since the coast is quite favourable for catching fish. Most of the locals just catch the fish for their own subsistence, while a share of them sell it. I decided to register my own company and sell the fish to Tyson, who would package it responsibly, and sell it across the country. I actually started my business before registering the company, and by the time I had enough of a hold in the local market, I applied to Tyson to be a supplier. However, they required me to be registered as an established supplier from Vizag, and to facilitate the same, I had to register my business. When I reached the office, I did not realise I lacked the necessary documents required for registration, so I had to come back two days later. At the office, they thankfully had a token system, and my number was called after three hours. At the counter, the person seemed quite surprised to see that I had applied for a fishing licence. To my surprise, he suggested me to skip this process and continue with my business! I had to tell him that I needed the licence to supply to an MNC, to which he understood. He aided me in the whole process, but it did take a lot of time - various departments required their own set of documents and clearances. In about two weeks, my business was registered, and Tyson bought my product a month later. |
There will be a lot of running around - even if the process is less rocky. I know of people who had to spend weeks running around the offices. Carry extra copies, the department office doesn't have a copier. Confusing laws that say different things |
There are various problems if one wants to start their own business in India. Firstly, the confusion of requirements to start business. Unless you contact a broker or a CA, you cannot get required certificates done. Secondly, taxation. There are whole lot of tax procedures which are too complicated. VAT, CST, Income tax, TDS- the list is endless. There are too many loopholes and too many things to take care of. Every month, the tax clerk comes to our office and takes 300 rupees just to ensure we are compliant and in no trouble, and gives his signature on our monthly VAT returns. If we dont pay him, it would atleast take 2 days of our time to get things done properly. |
