Tourism and F&B licenses | Can’t find information | I have recently started a new business in Goa in the hospitality and tourism sector. I tried to register a new business, register property, get permissions and licenses under environment laws, get my building’s plan approved, get electricity connection and tourism, food and beverages licenses. The paperwork that was required for getting licenses is efficient and streamlined but the procedures and processes involved in getting these licenses are very complicated. The procedures are not clearly defined and one can easily get confused since there is a lot of contradicting information. The government officials are themselves confused and do not have any sort of clarity since the procedures keep on changing frequently. All of this leads to delay at the cost of the citizen’s time, effort and money. |
My advice to other entrepreneurs is that - you should start all the procedures as soon as possible as the time taken to obtain licenses can vary from a few days to even a few months. I am of the opinion that if you have a certain kind of rapport with certain officials or “know” a few of them it tends be of great help in getting your licenses on time. |

Doing business in India is like travelling on a road with multiple roadblocks. Every hurdle has to be crossed in order to reach your destination. Unnecessary & excessive laws hamper business growth. Time consuming approvals required at every step.(1) As an example, Indian passport applicants in Palghar district of Western Maharashtra are asked to bring one witness(2) who is not a relative and should reside in the same building as the person who wants a passport. Does such a rule even exist? No such law is clearly mentioned on Passport Seva website(3). So, an applicant has to visit the Passport Seva Kendra (PSK) with original documents, then again to Police Station with same original documents and also the witness from same building. Why can't both be integrated? Also, laws need to clear cut for valuable documents like a passport. Any genuine entrepreneurs, small businesses or solo travellers in Palghar district may not be able to expand their journeys, if they can't bring witness from same building. In my opinion, this is just ridiculous! One shouldn't have to go through such pains to obtain a passport. And even if the procedure is a little lengthy, they should at least mention it clearly on the website. It was quite a task to get a VAT certificate for our social enterprise. It took close to a year, as the process was lengthy and the officials kept asking for newer documents at every visit. |

Getting the permits was not an issue, apart from finding information about it. I did everything myself, and got all the permits within a month, and my food supply company was up and running within six weeks. The real problem arises after you start the business. The attitude of customers/vendors/clients. People feel no remorse about wasting someone's time, or indulging in petty cheating. Of course things like these are present in the west too, but the magnitude is different. Oh, and this is more present in North India than in South! This reflected even while I was getting my permits- people just wasted everyone else's time, if it meant getting their work done five or ten minutes earlier. |

There was denial for commercial electric connection on freehold plots. They agreed later, after repeated requests and talking strictly in a stern tone. I needed to get commercial connection to another freehold plot and I am not sure whether I will be able to get that without paying bribe or not. Auditors also tell you a lot of rules at the time of inspection, seek monetary benefits to turn a blind eye. There is no website or one place where we can get a list of all the rules to be followed. The process of registering a firm is also ironical. They ask three guarantors who have been doing business for last couple of years (I think 3 or more) and have been filing returns timely. In case you do not have three guarantors you can also get a fixed deposit opened of 25,000 in the name of the firm and use that as the guarantee. Now the irony here is that hardly any bank would accept to open a fixed deposit in the name of the firm which is not yet registered. Since we did not know enough businessmen in Greater Noida, we visited a number of banks who refused to accept money and open a FD in the firm's name. Luckily I met a bank manager who understood and agreed to help. This is how we got a FD and hence were able to get the firm registered almost when we were about to lose hope. Another experience is that when two different states get involved, different taxes also get involved. This is applicable for goods being brought into Delhi from another state on C.S.T. We need to share a copy of bill with the Delhi client who then sends a D-form and only then can the goods be brought into Delhi with the bill and the D-form from the client. This form contains same information present on the bill i.e. - date, goods, quantity, vehicle registration number and the billed amount. This process can be managed if you bill electronically and share the documents via email. Doing the same manually will involve additional delays. I think GST might be a big step in resolving this issue. |

I tried to set up an e-commerce firm myself in Mumbai. The whole process was just a big headache. You don't understand who is going to look after your concern as people are mostly busy with their own personal schedule and they don't even listen to you or have the time for your concerns or doubts. If you have to get your work done, you have to wait for them to get free and eventually bend a little and be extra buttery to ask them to do your job. When they start doing your work, they would ask you questions in Marathi and that's the most irritating part if you have to register your start up in Maharashtra. Come on, you have to be kidding me, asking me to do something in Marathi! I got the form in English, and Marathi is never simple to comprehend. They use terms in the form and expect us to know the terms. Had we known those terms, we would have not asked for their help. |
Get someone to get your work done. Take a Charted Accountant’s or a lawyer’s help. You would forget about who you are when you step into the mess they are into. The lawyer or the Charted Accountant would handle everything for you. |
