Register the business Acquire land Register property Get registration and licenses under labour laws Get building plan approved Get electricity connection Pay taxes File returns under labour laws, environmental laws, tax laws, etc. |
It was easy for my family to set up our medicines wholesale business. We tried to register our business, acquire land, register property, get permissions and licenses under labour laws, get building plan approved, get electricity connection, pay taxes, file returns under labour laws and tax laws. I would say it was easy for us to set up and register our business because we were ready to bribe the officials. In my opinion that is a given and probably is mandatory to get your work done. | My advice to other businessmen would be either be ready to bribe or have patience for the lengthy procedures and formalities in order to start and register your business or start up. |

They keep asking me to submit some new document every time |
I helped to register a non-governmental organisation in the social sector in Bengaluru, Karnataka. The number of documents required to do the work was boggling, and very troublesome. It was quite a task to get a VAT certificate for our social enterprise. It took close to a year, as the process was lengthy and the officials kept asking for newer documents at every visit. |
An advice to younger entrepreneurs would be that if you are not ready to bribe the officials, you should be ready to go through a lengthy process to get necessary certificates and documents. | Keep it Anonymous | Anonymous | 9916967853 | nitin.anjaneya@gmail.com | I have read and I agree with the Privacy Policy mentioned below | Keep me updated about responses to my report and experience. | Yes

In my opinion, it is absolutely not easy to conduct business in India. I tried to establish a brand that produces sunglasses in Ahemdabad, Gujarat. Aside from the total lack of information, I had to submit completely unnecessary documents. I fail to understand as to why my phone bill was required, when I’m already submitting another documents for address proof? I still don't know why they need so many documents. I did not have any foresight, and it was made worse by the bureaucracy at the government offices, where nobody really knew anything. I had to go to various offices and stand in the queue to figure out which document is required by which window. I also did not have a team, and thought I could do everything by myself - one can't fight the bureaucracy alone! |
I acted a bit prematurely in terms of starting a business, but I advise other budding entrepreneurs to establish a team from the start, and trust them. I thought I could run around and do the paperwork myself, but one requires legal help in establishing a business in this country for sure. You cannot do everything on your own even if you are of the idea that you know the procedures. If you want to excel in a certain sector, you need to know the sector in and out. | Media | Siddhant | 9033227176 | sjgupta010@yahoo.in | I have read and I agree with the Privacy Policy mentioned below | Yes

I had a lot of problems starting my restaurant in Mumbai. It was not easy for me to start my business. I tried to register the property, get permissions and licenses under the labour laws. My restaurant serves alcohol and even has hookah. So for me it was all the more difficult. I had to run from pillar to post to get my permits in place. I also had to pay bribe in order ‘to get things done’ at a faster pace. Apart from that once my restaurant started, I had to tip off the policemen in order to keep my business going. Or else for whatever stupid reason and probably an invalid one, my restaurant would have been shut down permanently. This is my experience in Mumbai and I am not aware of other cities in India. The customers, vendors and clients are also at times indifferent. They don’t feel any remorse in wasting someone’s time, energy and indulge in petty cheating at the cost of others. I am sure such instances take place abroad as well but the magnitude would definitely be significantly lesser. |

I was told it would take five years for me to get a permanent certificate for my financial services company and until then a temporary certificate would be issued. I bribed Rs. 6,000 and got the registration certificate in three days. My father already had one manufacturing business and intended to open a new business. Since he did not have the time to run around for completing the formalities, we had to hire an accountant and he charged us Rs. 40,000. Like most of the other entrepreneurs, even I had experienced what it really meant to go to bureaucrats and experienced red tape. I had to go various people for ‘n’ number of signatures and stamps. There were so many corrections I had to make in multiple documents to get my company registered. I don’t think there is anything called as – ‘single window clearance’. My father had to set up a chemical plant and had to wait for a year to get environmental clearances. He also had to pay bribes along the way and despite wait for a year. How do we make in India if we are not allowed to make in India? There is no clear knowledge about how to start a company. Most of the people are of the opinion that a lot of money is required to start a company. I started my company with Rs. 8,000 out of which Rs. 6,000 was a bribe. Even if people have some really fascinating ideas, they don’t start a company because they think that it will cost them a lot. The tendering process of the government is flawed and corrupt. It is always given to people who are ‘known’ to the government officials. Once when we managed to get a contract on a fair basis because we really did quote low prices, we were called and blasted by an official. He asked us how we could take up the project when we had no clue about the place where the project was going to start. He finally introduced us to an agent who had taken care of all the previous people who had managed to get the contracts. This is my experience of Pune, Maharashtra. I have no clue how does it work anywhere else in the country. |

I tried to register a marketing firm in Pune, in order to kick-start my career. The process itself took hardly two weeks from when I applied, but it involved a lot of running around for my family. Since I am a resident of Delhi, most of my documents were back at home. Thus, my family had to post them. Fortunately, they arrived on time. But I had to submit two identification proofs, so I had to get a driving licence made within a month solely for the purpose of identification, since I did not possess an Aadhar or a voting card – I just had a my passport. One of the main issues I had was the lack of information that was available- which office do I go to. Can I register a name in Pune and use it later in Delhi? Which desk was I supposed to go to? What are the working hours? None of the information was available online, so my father suggested that I hire a CA to register it for me. After hiring the CA, the process was very smooth. I don’t understand why I had to hire the CA, though. This is the problem with our country- the requirement of middlemen to conduct business. I think this is the worst problem that hampers the conduct of business in our country- it should definitely be made easier for citizens to start a business if we wished to! |

Everything is difficult if you are starting from scratch to set up a business. • Finding office space: Not everyone has big enough a house or circumstances to incubate the organisation at home. • Something as simple as commuting: It is hazardous to drive, and arduous to take public transport. • Government policies/banking system: Something as simple a company formation - if you got for private limited model, the Registration Of the Company expenses require a fair amount. Cheaper option is to register company under partnership act (only if you have a friend who is a CA/CS/Lawyer and will help you out). Again, if your company is under partnership firm, banks won't give out unsecured loans/ credit cards to you/ your employees. This is the reason many good and hard working employees can leave the job with your company and go anywhere else where they get better facilities. • No regard for Intellectual Property Rights or its implementation: Almost illiterate cops or Economic Offences Wing Officials dare not bothered about whether stealing/copying code/project plans/content is a big deal! • There are multiple overlapping compliance checklists that will take you ages to get a grip on. • Rampant corruption: To set up a meeting, to get anything registered, to not stand in the line for hours- every little thing requires a bribe to get your work done. This can go on forever. There is no way that we can ever reach the competence levels of foreign countries. I’ve lost hope in our system! |
It's a difficult process. If you have the time, money, and energy, you might just be able to start your own business. Bureaucrats are more often insensitive than not, and do not have the mentality of helping citizens. Rather, they have the mentality of making things as difficult as possible - they think their job is to make things more difficult for citizens. A lot of markets are controlled by guilds and associations of existing businessmen. They place a high cost of entry for new entrants, especially someone without connections in the business community. I experienced extortionate behavior by local working class people, goons, thugs and small time politicians/crooks. Bribes on the preface of "donations" for 100 different religious festivals a year are taken. There is a total lack of rule of the law and lawlessness. It is a utter failure on the part of the police and judiciary since they do not have the capacity to dispose cases in a timely manner. One needs to be careful and look out for extortionate, fraudulent and deceiving behavior by lawyers and some Charted Accountants. |

For me the problem was dealing with the labour. The problem is that they deserve better, but I cannot pay them more than the market for the fear of being noncompetitive and losing business. But then they don't care much for the money they are paid. Timelines, work ethics, etc. mean nothing to them. But I don't blame them. Right now it's Modi ji's kripa. My business is dead for next few months. No new projects are going to come in, as people are going to hold onto their money now especially if their net worth is less now maybe due to black money, or maybe due to crashed property. The future is uncertain. This policy is really anti-small trade business. People like Ambani selling the daily essentials to common men will not be affected, since demand will never drop. Then, there is also the fear of being prosecuted for something you haven't done wrong. For example, not deducting the right TDS, or putting the wrong tax. Kejriwal had come out with a system of code for each item. Nobody implemented it! We do our work, but need to keep up with stupid compliances, which are subject to whims and fancies of illiterate politicians- most of whom haven't seen a business meeting in their lives, I am sure! It just takes up so much of your time. Harassment by officials is a valid and certain threat. |

There is a lot of competition in Vizag in the Fishing sector, since the coast is quite favourable for catching fish. Most of the locals just catch the fish for their own subsistence, while a share of them sell it. I decided to register my own company and sell the fish to Tyson, who would package it responsibly, and sell it across the country. I actually started my business before registering the company, and by the time I had enough of a hold in the local market, I applied to Tyson to be a supplier. However, they required me to be registered as an established supplier from Vizag, and to facilitate the same, I had to register my business. When I reached the office, I did not realise I lacked the necessary documents required for registration, so I had to come back two days later. At the office, they thankfully had a token system, and my number was called after three hours. At the counter, the person seemed quite surprised to see that I had applied for a fishing licence. To my surprise, he suggested me to skip this process and continue with my business! I had to tell him that I needed the licence to supply to an MNC, to which he understood. He aided me in the whole process, but it did take a lot of time - various departments required their own set of documents and clearances. In about two weeks, my business was registered, and Tyson bought my product a month later. |
There will be a lot of running around - even if the process is less rocky. I know of people who had to spend weeks running around the offices. Carry extra copies, the department office doesn't have a copier. And lastly, treat the officials well - they are more likely to get your work done if you treat them like humans! | Keep it Anonymous | Anonymous | - | abcd@gmail.com | I have read and I agree with the Privacy Policy mentioned below | Yes

My experience was not good at all in terms of starting my business. There are officials who will not ask for bribes directly but by the way the whole system runs and procedures are delayed for some or the other reason, you are left with no other option. The documents to be submitted were so many. It is high time that we go paperless and make it easier not only for the officials but also for us. It will reduce the time period as well. |

He was having a rate card - who will take how much and for what work. The rate varies from service to service. The brokers are influential enough to speak directly to the so called top officer namely "Registrar" in that office. It is a common scene in all government offices such as Regional Transport Office, Tehsildar Office, Revenue Office, Collector Office and even in Court premises. It is very difficult for a common man to complete his/her work in government office without these intermediaries/ brokers or middleman. Brokers are acting as one window system to complete your work in government offices. |
a) Government should get rid of all brokers/intermediaries from government offices. They should not be allowed to run shops near these government offices. b) Government should not allow intermediaries to roam freely in government offices. Why is the government allowing access to these middlemen/ brokers in government offices and access to government seal, computer, etc? c) Government should display "citizen charter" with more details, which can be understood by a common man. d) Like social audits, we should create "social anti-corruption squad'', where common people can enter into any office and search officials for any possession of money apart from his own. I understand it is not practically feasible, still, we need to create some kind of responsibility amongst government employees. Or any other way accountability can be assured. e) Why doesn't the government not talk about performance of each and every employee of the office. Like in private sector, we should assess employees' performance with more transparent ways instead of present practice like 'performance report by higher official'. All the government officials are out to cheat the common people. So, the performance of the employees should be output based and outcome based. For, example, how many files are seen by a clerk on one day? or how many certificates are issued by VAO in a month?, etc. f) What the employee unions are doing I don't understand. In the old days, the employee unions were formed to strengthen the unity of the employees against their bosses. But today, these employee unions (government) are threatening the bosses. It is a good thing that they are joining hands for their rights. At the same time, they should think about how they are giving service to its people (for which they are getting paid). Are the unions taking actions against its employees, who are corrupt, not working properly, torturing the people unnecessarily, etc? If they think in such a manner, only then they have right to ask for a pay hike, employees rights, etc. g) I don't understand what the department vigilance commissions and anti-corruption bureau are doing. They only showcase the case when they catch the officers, after that, they are not showcasing the progress of the case to the public. How many people are really given punishments for their corrupt acts? |

Getting the permits was not an issue, apart from finding information about it. I did everything myself, and got all the permits within a month, and my food supply company was up and running within six weeks. The real problem arises after you start the business. The attitude of customers/vendors/clients. People feel no remorse about wasting someone's time, or indulging in petty cheating. Of course things like these are present in the west too, but the magnitude is different. Oh, and this is more present in North India than in South! Confusing laws that say different things |
There are various problems if one wants to start their own business in India. Firstly, the confusion of requirements to start business. Unless you contact a broker or a CA, you cannot get required certificates done. Secondly, taxation. There are whole lot of tax procedures which are too complicated. VAT, CST, Income tax, TDS- the list is endless. There are too many loopholes and too many things to take care of. Every month, the tax clerk comes to our office and takes 300 rupees just to ensure we are compliant and in no trouble, and gives his signature on our monthly VAT returns. If we dont pay him, it would atleast take 2 days of our time to get things done properly. |

People are unwilling to pay. Period. You can deal with all the bureaucracy, but what can you do if people just don't want to pay? Ad based model is not feasible for every product. Till now, I have mostly focused on the Indian market. I still think there is a huge opportunity. For example, consider admission process in educational institutes, their examination processes etc. Most of them are still manual and quite cumbersome. The one we're starting now is an e-commerce business for a niche consumer good. We want to share things about everything about the business; starting from how we decided on the product and the business model, about marketing and gaining initial traction. We're trying to figure out social media, even though we both are kind of shy on the social networks. We might have a lot of resources on startups from the US and other countries. But a fact of the matter is that starting something in India (as we've learned) is a different beast. We need to start discussing things in the open so that we can learn from each other. |
Plan well. Starting a business isn't the tough bit, sustaining it is. | Keep it Anonymous | Anonymous | - | abcd@gmail.com | I have read and I agree with the Privacy Policy mentioned below | Yes

In short, it was a nightmare. I tried to start a clothing brand late last year, thinking that I would conduct a fair business in Pune. I wanted to register my company legally, and pay my taxes duly, irrespective of how my business went. But after going through this procedure, I realised why people don't take the white route! It takes a ton of time to get everything sorted, and more so to roll out. Getting clearances from these babus was one thing, and sustaining the business entirely another. It seems like they have all the time in the world to harass us, but not to help us. I am thoroughly disillusioned with the state of the business sector in this country. Though my business is fairly successful now, I can never forget the hell I have been through to make it till here. I can only hope it is the not the same for others. |

I have a transport company of my own, and has been successfully running for nearly two years now. The setting-up took a bit of time, especially since the Himachal Pradesh police is a little prudent about your permits and such documents. But once I got it, it was a smooth sailing. I would say having someone who has the knowledge of the field is necessary and important- it helps to have someone who has established their business in the field. In my case, I had an uncle in the same transport business, so that helped me out immensely. |

Under Swatchh Bharat mission, the municipal corporations are supposed to build and operate public toilets and community toilets. Even after identification of land, the allocation process is not very clear at district levels. The MC should identify land and make it readily available for interested parties to built and operate toilets by CSR funds. There is no clear mechanism/process/instruction how to apply for land for building toilets. hence it took us more than 6 months to get land. |
Under SBM, there should be clear process prescribed to MC for allocation of land for faster implementation of projects | Both | Abhishek | 7569505721 | kpanwars@gmail.com | I have read and I agree with the Privacy Policy mentioned below | Keep me updated about responses to my report and experience. | No

There was denial for commercial electric connection on freehold plots. They agreed later, after repeated requests and talking strictly in a stern tone. I needed to get commercial connection to another freehold plot and I am not sure whether I will be able to get that without paying bribe or not. Auditors also tell you a lot of rules at the time of inspection, seek monetary benefits to turn a blind eye. There is no website or one place where we can get a list of all the rules to be followed. The process of registering a firm is also ironical. They ask three guarantors who have been doing business for last couple of years (I think 3 or more) and have been filing returns timely. In case you do not have three guarantors you can also get a fixed deposit opened of 25,000 in the name of the firm and use that as the guarantee. Now the irony here is that hardly any bank would accept to open a fixed deposit in the name of the firm which is not yet registered. Since we did not know enough businessmen in Greater Noida, we visited a number of banks who refused to accept money and open a FD in the firm's name. Luckily I met a bank manager who understood and agreed to help. This is how we got a FD and hence were able to get the firm registered almost when we were about to lose hope. Another experience is that when two different states get involved, different taxes also get involved. This is applicable for goods being brought into Delhi from another state on C.S.T. We need to share a copy of bill with the Delhi client who then sends a D-form and only then can the goods be brought into Delhi with the bill and the D-form from the client. This form contains same information present on the bill i.e. - date, goods, quantity, vehicle registration number and the billed amount. This process can be managed if you bill electronically and share the documents via email. Doing the same manually will involve additional delays. I think GST might be a big step in resolving this issue. |

Tourism and F&B licenses | Can’t find information | I have recently started a new business in Goa in the hospitality and tourism sector. I tried to register a new business, register property, get permissions and licenses under environment laws, get my building’s plan approved, get electricity connection and tourism, food and beverages licenses. The paperwork that was required for getting licenses is efficient and streamlined but the procedures and processes involved in getting these licenses are very complicated. The procedures are not clearly defined and one can easily get confused since there is a lot of contradicting information. The government officials are themselves confused and do not have any sort of clarity since the procedures keep on changing frequently. All of this leads to delay at the cost of the citizen’s time, effort and money. |
My advice to other entrepreneurs is that - you should start all the procedures as soon as possible as the time taken to obtain licenses can vary from a few days to even a few months. I am of the opinion that if you have a certain kind of rapport with certain officials or “know” a few of them it tends be of great help in getting your licenses on time. |

It was easy for us to start the business because we took help of our sales tax consultant to get the registration process initiated. His guidance and the ‘right’ contacts he had facilitated the registration process. | My advice for others would be – go through an expert accountant or a lawyer who has an expertise in the domain of getting the business or a start up registered. It was pretty much easy for us to set up our media enterprise in Ahmadabad, Gujarat. We are a partnership firm called as – Videowala and mostly work for the Adani Group and make short films as a part for their Corporate Social Responsibility. We won the 62nd National Film Award for the year 2014 under Best Debut Film of a Director (Non-Feature) Category for our documentary – ‘Goonga Pehelwan’. We are a partnership firm and a partnership firm is one of the easiest to register. It took us just five days to register the business and did not drain out our energies. Hence we could better concentrate on our business. |
My advice to other start ups would be if you have no idea about the procedures involved and the paperwork, go through an accountancy firm or some legal experts. Acquiring another business | Submitting the same document to different departments |
I had a difficult time starting my software business in Delhi. I didn’t have to pay a bribe to register a Pvt. Ltd Company but had to pay a bribe to complete the registration of a proprietorship. There is no clarity on taxation. For example, when you pay someone for their services you have to deduct 10% TDS. I had no idea of any sorts if that person is Amazon or a MNC who have their offices in India and if I had availed their services did I need to deduct 10% TDS. Amazon demanded a full payment. I contacted a dozen charted accountants and even a friend of mine who is in the Indian Revenue Service. None of them had a clue. But all of them suggested paying TDS to be on a safer side. So I had to pay the full amount to Amazon and on the top of that 10% to the dear Government of India. There are so many scenarios where there is no clarity at all. Investment laws are a total mess. God help you if you ever receive a FDI. I received it once only to the return the amount of Rs. 5 lakhs. This is because the amount of running about I would have to do was not worth the amount. The legal system is terrible. If I may say, it is effectively a joke. An acquisition of one my products fell through because the acquirer did not want to make disputes subject to the Indian jurisdiction in the contract. In the acquirer’s own words – “the Indian legal system isn’t held in very high regard here” (in Australia). There are high costs involved in doing business especially in India. My gateway charges a 5% premium (so a 3% + a 5%) for the Indian Businesses because of the increased cost of operations. So an American Company charges only 3% whereas I have no option but to settle at 8%. There are innumerable other hassles as well. It is like a death by giving thousand cuts. |
Even in the software industry, regulations are very high. Be patient and prepared to wait for a while to get through. |
